These Terms of Service ("Terms") govern your access to and use of the ChallengeU2 website, mobile applications, and services (collectively, the "Platform"), including participation in online challenges, account creation, and interactions with our community. By using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

1. Acceptance of Terms

By registering an account, participating in challenges, or otherwise using the Platform, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to be bound by these Terms, our Privacy Policy, and any applicable guidelines or rules for specific challenges. We reserve the right to modify these Terms at any time, with material changes notified via email or on the Platform. Your continued use after such changes constitutes acceptance.

2. User Accounts and Responsibilities

To access certain features, you must create an account with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and all activities under your account. Notify us immediately at support@challengeu2.com of any unauthorized use. You agree not to create multiple accounts for evading suspensions or participating in challenges unfairly.

3. User Conduct and Prohibited Activities

You agree to use the Platform only for lawful purposes and in a manner that does not infringe on others' rights. Prohibited activities include:

• Cheating, hacking, or using bots/scripts to manipulate challenge outcomes or progress tracking.
• Submitting false, misleading, or plagiarized content in challenges.
• Harassing, threatening, or spamming other users, including in comments or messages.
• Uploading viruses, malware, or harmful code.
• Violating intellectual property rights, such as copying challenge content without permission.
• Engaging in commercial activities without our consent, like promoting competing services.

We may monitor user activity for compliance and take action, including warnings, content removal, account suspension, or termination, at our discretion.

4. Challenge Participation

Challenges on the Platform are designed for personal growth, skill-building, and community engagement. By participating:

• You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your submissions (e.g., progress updates, media) for Platform purposes, including promotion.
• Submissions must comply with these Terms and not include illegal, obscene, or harmful content.
• We do not guarantee challenge availability, prizes (if offered), or outcomes; participation is at your own risk.
• For AI-enhanced challenges, your inputs may be processed by third-party AI services (e.g., OpenAI) to provide feedback, but outputs remain your responsibility.

Specific challenge rules may supplement these Terms; conflicts resolved in favor of the Terms.

5. Intellectual Property

The Platform, including its design, code, challenges, and content, is owned by ChallengeU2 or its licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.

User-generated content (e.g., challenge submissions) remains your property, but you grant us the license described in Section 4. By posting, you represent that you own or control rights to such content and it does not infringe third-party rights.

We respect intellectual property and have a process for reporting infringements under DMCA; contact support@challengeu2.com.

6. Payments and Subscriptions (Freemium Model)

The Platform offers free basic features and paid premium subscriptions processed securely via Stripe. You authorize recurring payments for subscriptions and agree to our refund policy (available on the Platform). All fees are non-refundable except as required by law. We may change pricing with notice; continued use constitutes acceptance.

7. Health and Fitness Disclaimer

Challenges, especially fitness-related ones, are for informational and motivational purposes only and not professional medical advice. Consult a qualified healthcare provider before starting any program. ChallengeU2 is not liable for any injuries, health issues, or damages arising from participation. You assume all risks associated with physical or mental activities on the Platform.

8. Limitation of Liability

To the fullest extent permitted by law, ChallengeU2 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangibles, resulting from your use of the Platform. Our total liability shall not exceed the amount you paid us in the past 12 months. The Platform is provided "as is" without warranties of any kind, express or implied.

9. Termination

You may terminate your account at any time via settings. We may suspend or terminate your access for violations of these Terms, with or without notice. Upon termination, your right to use the Platform ends, and we may delete your data subject to our retention policies.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware. You agree to waive jury trials and class actions. 11. Changes to Terms

We may update these Terms to reflect changes in our services or legal requirements. We will post revisions on the Platform and notify you for material changes (e.g., via email). Continued use after updates constitutes acceptance. Review periodically.
